An Annual Negative Departure in excess of 90,000 acre- feet beginning the sixth full calendar year after entry of the Consent Decree shall be treated as the equivalent of 90,000 acre-feet for the purposes of calculating Accrued Index Departure. 4.4 Suspension of Annual Index Departures
