if New Mexico exceeds the Accrued Negative Departure limit of 150,000/120,000 acre-feet in three (3) consecutive years, New Mexico shall provide 12,000 acre-feet of water in excess of its Index Obligation for each year that it exceeds the Accrued Negative Departure limit. New Mexico shall have three (3) years to provide the full 36,000 acre-feet.
