Seeking still another way around the consent requirement, Mr. Landor turns next to the fungibility of money. The individual defendants, he observes, receive paychecks from LDOC, and some of that entity’s funding comes from the federal government. As a result, Mr. Landor submits, the individual defendants are indirect recipients of federal funds and, for that reason, should be deemed to have im plicitly consented to RLUIPA liability.Read in context ›
