As for the “why”: These historical analogues were intended to vindicate property rights and to address a range of concerns associated with violations of those rights by armed individuals on private land. The laws protected property owners’ right to exclude by requiring that visitors seek “license or permission” before they were permitted to carry a gun onto private property. 1771 N. J. Laws 26; 1721 Pa. Acts, §3, at 255. And even an anti-poaching focus aimed to protect property rights by preserving the game on the property for the owner or the owner’s licensees. See Brady, 78 Stan.
