We granted certiorari, 607 U. S. 961 (2025), because the Courts of Appeals have differed on when appeal waivers are unenforceable in the sentencing context. Most have held that a waiver cannot be enforced if doing so would result in a miscarriage of justice.The Fifth Circuit and a few others have declined that route, instead specifying just a few discrete circumstances in which an appeal can occur despite a waiver.Today, we adopt the “miscarriage of justice” approach, and accordingly remand this case to the Fifth Circuit to consider whether, under that standard, Hunter's appeal should still be dismissed.
