In 1972, in a belated but historic response to persistent discrimination against women in educational institutions, including in athletics, Congress passed and President Nixon signed Title IX of the Education Amendments of 1972. Title IX prohibits “discrimination under any education program or activity receiving Federal financial assistance” “on the basis of sex.” 20 U. S. C. §1681(a).
