Bost nevertheless insists that his case is distinct from Clapper because he knows that the State will apply its 14day ballot-receipt deadline in his next election. That fact, he says, sets him apart from the attorneys and human-rights organizations in Clapper, who could not prove that the Federal Government would invoke FISA against them or their clients. Stated differently, Bost is certain that the State will apply the ballot-receipt deadline, whereas the Clapper plaintiffs could only speculate as to FISA's future application.
