Importantly, the Helms-Burton Act grants the President plenary gatekeeping power over whether lawsuits under the Act can proceed in court. Section 6085(c)(1)(B) authorizes the President to “suspend the right to bring an action . . . with respect to confiscated property” for six months at a time “if the President determines . . . that such suspension is necessary to the national interests of the United States and will expedite a transition to democracy in Cuba.” See also §§6085(b), 6085(c)(2), 6082(h)(1), 6064(a) (conferring additional suspension authorities on the President).
