But the Helms-Burton Act is entirely different. Congress took the highly unusual step of creating a cause of action that expressly applies against foreign (here, Cuban) agencies and instrumentalities. Only a few other laws in the U. S. Code create a cause of action that expressly applies against a foreign sovereign or its agencies and instrumentalities.
