Many provisions of the Helms-Burton Act authorize the President to suspend or permit suits under the Act. Most relevant is §6085(c)(1)(B), which empowers the President to “suspend the right to bring an action . . . with respect to confiscated property” for six-month periods if the President determines and reports that the “suspension is necessary to the national interests of the United States and will expedite a transition to democracy in Cuba.” Section 6085(c)(2) authorizes additional six-month suspensions. Section 6064(a) likewise authorizes the President “to suspend the right of action . . . with respect to actions thereafter filed against the Cuban Government.” And §6085(d) allows the President to “rescind any suspension” in order to “expedite a transition to democracy in Cuba.”
