The Court discussed this exception in Caterpillar Inc. v. Lewis, 519 U. S. 61. In Caterpillar, Lewis was a citizen of Kentucky who brought a product-liability suit in state court against Caterpillar, a Delaware- and Illinois-based equipment manufacturer, and Whayne Supply, a Kentucky company that serviced Caterpillar equipment. Id., at 64–65. Lewis's insurer (a Massachusetts corporation) intervened as a plaintiff and asserted claims against both Whayne and Caterpillar. Id., at 65. At that point, complete diversity was lacking, as there was one plaintiff (Lewis) and one defendant (Whayne) from Kentucky.
