As a fallback, Hain argues that, even if the jurisdictional defect was not cured, Whole Foods should now be dismissed under Federal Rule of Civil Procedure 21. That Rule permits a federal court “on its own” to “add or drop a party” “on just terms.” This argument is unavailing.
