Some courts review the entire inquiry (both the underlying factual findings about what happened to the applicant in her home country and the agency's application of the statute to those findings) under the substantial-evidence standard.Other courts break down the inquiry into two parts, reviewing the agency's factual findings for substantial evidence and its legal conclusions de novo.Yet even those courts are not always careful when differentiating between factual findings and the application of the law to those findings, sometimes applying substantial-evidence review to the entire inquiry.
