Back to the cases at hand. After the First Step Act became effective, Rutherford moved for compassionate release. He argued that “extraordinary and compelling” reasons warrant a reduction because he had received an “unusually long sentence under a statutory provision that Congress has since found too punitive but has not made retroactively applicable.” 2 App. in No. 23–1904 (CA3), p. 58.
