Again, the majority largely skips over the stare decisis analysis and prefers instead to decree that Justice Scalia was right in Sosa after all. Ante, at 7–12. In so doing, the majority forgets that while creating causes of action may be a task primarily for Congress, so too is correcting erroneous interpretations of statutes. See Kimble, 576 U. S., at 460. In nonetheless reaching out to correct a perceived error in Sosa, the Court does not honor the constitutional division of labor between Congress and this Court. Instead, it disrespects it. Proper respect for Congress should have led to a different outcome today.
