The Court suggests that “barring other statutory or con stitutional considerations, plaintiffs have been able to enforce their legal rights even when they are violated during war.” Ibid. (emphasis added). Here, however, it is precisely because of “constitutional considerations” that petitioner's state-law claims are preempted.
