This right of action lay dormant for more than two decades. The Act authorizes the President to “suspend” the Title III right of action based on a determination that the suspension is in the national interest and will “expedite a transition to democracy in Cuba.” §§ 6085(c)(1), (2). Presidents Clinton, Bush, and Obama continuously suspended the right of action from its effective date onward. But, in May of 2019, President Trump allowed the suspension to expire, permitting the right of action to go into effect for the first time. That policy change exposed traffckers in confscated property of United States nationals to Title III liability.
