The second notable feature of TPS is that the statute requires the Government to terminate a country’s TPS designation if the Secretary determines that the country “no longer continues to meet the conditions for designation.” §1254a(b)(3)(B). The Secretary generally makes such determinations as part of an ongoing review of all TPS designations. The Secretary is instructed to review each TPS designation at least every 18 months. §§1254a(b)(2)–(3). During this review, the Secretary must “consul[t] with appropriate agencies of the Government” and “determine whether the conditions for such designation under this subsection continue to be met.” §1254a(b)(3)(A). If the Secretary takes no action, a TPS designation automatically extends for another six months. See §§1254a(b)(2)(B), (3)(C).
