The Second Circuit also denied the Government’s request for a stay. It concluded that it likely had jurisdiction, that the challengers had at least one strong APA claim (namely, that the Secretary acted contrary to law by failing to engage in adequate consultation with other agencies before terminating TPS), and that the other stay factors were not met.
