Few cases implicate these concerns to a greater degree than Humphrey’s. For the better part of the last century, Humphrey’s has guided Congress in constructing the modern system of Government, including dozens of independent agencies that remain central to protecting the Nation’s economy, health, safety, and more. At times, Congress has done so in express reliance upon the rule stated in Humph rey’s. Within weeks of Humphrey’s being decided, for instance, the House amended the bill establishing the National Labor Relations Board (NLRB) to include removal protections, with the express aim of “provid[ing] that the decision of the Supreme Court in the recent Humphreys case shall be embodied in the statute.” H.
