Even for the free black population of the United States, there was substantial opposition to application of the British rule. Many States, both in the South and Midwest, restricted the rights traditionally associated with citizen- ship—such as the ability to settle, vote, and serve as a witness in court—to white residents. And there was some federal support for this understanding of citizenship. In Britain, on the other hand, as the Court notes, the common law did not take account of race.
