In this case, because we are concerned with the meaning of citizenship under the Constitution, it is the second alternative that is important for present purposes. In Lynch v. Clarke, 1 Sand. Ch. 583 (N. Y. Ch. 1844), a decision on which the Court, respondents, and many amici heavily rely, the assistant vice-chancellor of New York suggested that the Constitution’s references to “citizen” incorporated the British rule, id., at 647, 655–657, but that is far from obvious.
