Thus, birthright citizenship has two separate elements. First, a person must be “born in the United States,” and second, he or she must be “subject to the jurisdiction thereof.” It is therefore critical to ascertain the meaning of “subject to the jurisdiction thereof.” And that is no easy task because, as we have often remarked, jurisdiction is a term of many meanings. Wilkins v. United States, 598 U. S. 152, 156 (2023). We must therefore determine which one applies here.
