When the Government institutes removal proceedings against an alien, the INA imposes various burdens of proof on the alien and the Government. See §§1229a(c)(2), (3). But, it does not specify whether the Government has the burden to establish that the alien is an applicant for admission in the first place, as opposed to someone already admitted.Read in context ›
