The majority’s interpretation of §§1225(a) and 1158(a)(1), moreover, vests limitless discretion in the Executive Branch to abandon its inspection and processing duties. If, as the majority holds, these mandatory statutory duties are not triggered until a noncitizen physically crosses the border, then the Government can easily ignore all these duties by preventing people from stepping across, as it did under the metering policy.
