New York charged Hernandez with intentional murder, kidnapping, and felony murder. The first trial ended in a hung jury, and a second trial began in 2016. Hernandez moved to suppress his statements to the detectives and the assistant district attorney, but the trial court denied the motion. It ruled that Hernandez was not in custody at the CCPO before he received his Miranda warning and that he had knowingly and voluntarily waived his Miranda rights at the CCPO and the district attorney's office before he made his later videotaped confessions.
