Consider (as the Court has failed to do) what the Government has and has not argued, as well as how it has behaved. In seeking this stay, the Government has not made any effort to prove that the enjoined mail-in ballot directives are lawful. Nor has it worked diligently to ensure that the voteby-mail changes the President has ordered were finalized timely so as to be effectively implemented ahead of the November elections.
