Marshall’s admonition that “it is a constitution we are expounding” is especially relevant when the Court is required to give legal sanctions to an underlying principle of the Constitution — that of separation of powers. “The great ordinances of the Constitution do not establish and divide fields of black and white.” Holmes, J., dissenting in Springer v.
